LEGAL & COMPLIANCE
Website Terms of Use
- Effective date:
- 20 August 2026
- Version:
- 1.0
These Website Terms of Use ("Terms") govern your access to and use of the AI SMITH public website, aismith.my (the "Website"). By browsing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
Entity and scope
The Website is operated by AI SMITH. Our verified legal entity name and registration details will be published here once confirmed. These Terms govern the public Website only — informational pages, forms, and public content. They do not govern any separate paid service, subscription, pilot, or platform agreement you enter into with us; a distinct Customer Services Terms document governs that relationship once you have an active engagement, and will be provided or linked to you before that agreement takes effect.
Acceptable use
You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of it. You must not attempt to gain unauthorised access to any part of the Website, its underlying systems, or any account, or use the Website to transmit anything unlawful, harmful, or deceptive. See also our Acceptable Use & Responsible AI Policy, which applies alongside these Terms.
Informational nature
Content on the Website — including descriptions of AI agents, workflows, outcomes, and industry information — is provided for general informational purposes. It is not a guarantee of a specific result, a binding proposal, or professional advice (including financial, tax, legal, or employment advice). Any specific commitment to you is made only through a separate, signed agreement.
Accounts and linked services
Where the Website links to a Customer Workspace, Partner Portal, or other authenticated environment, use of that environment is governed by separate terms and access conditions presented at login, not by these Terms alone.
Intellectual property
The Website, including its text, design, graphics, and the AI SMITH name and any associated marks, is owned by or licensed to AI SMITH and is protected by applicable intellectual property laws. You may view and download Website content for your own personal or internal business reference. You may not reproduce, distribute, modify, or create derivative works from Website content for commercial purposes without our prior written permission.
User submissions
If you submit information to us through a form, message, or other channel (an "enquiry," "feedback," or "submission"), you confirm that the information is accurate to the best of your knowledge and that you have the right to share it, including any third-party contact details submitted through a referral. We handle submitted personal data in line with our Privacy Notice. Please do not submit confidential, sensitive, or proprietary material you are not authorised to share.
Third-party links
The Website may link to third-party websites or resources. We do not control and are not responsible for the content, accuracy, or practices of third-party sites. Linking to a third-party site does not imply endorsement.
Disclaimers and limitations
The Website and its content are provided "as is" without warranties of any kind, to the extent permitted by law. We do not guarantee that the Website will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law, AI SMITH is not liable for any indirect, incidental, or consequential loss arising from your use of the Website. This section is a placeholder framework and will be reviewed for enforceability under Malaysian law before it governs any live claim.
Suspension and restriction
We may restrict, suspend, or terminate access to the Website, in whole or in part, at our discretion — including where we reasonably believe these Terms or our Acceptable Use & Responsible AI Policy have been violated, or where necessary to protect the security or integrity of the Website.
Governing law
These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the Malaysian courts, unless otherwise agreed in writing. This section will be confirmed by qualified Malaysian counsel before launch.
Changes
We may update these Terms from time to time. Material changes will be reflected by an updated effective date at the top of this page. Continued use of the Website after changes take effect constitutes acceptance of the updated Terms.
Severability and contact
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. For questions about these Terms, use the Contact page and select "General enquiry."
